All applicants for naturalisation, including those applying to naturalise on the basis of marriage or civil partnership, must demonstrate 'sufficient knowledge about life in the UK'. This includes meeting the English language requirement and demonstrating good character. Applicants must also meet specific residency requirements. Non-spouse applicants must intend to live in the UK permanently.

Non-Spouse Cases

Residence requirements for those applying for naturalisation as a non-spouse are:

  • They must have been physically present in the United Kingdom at the start of the five-year period ending with the date of application, and must not have been absent from the UK for more than 450 days during that period; and
  • They must not have been absent from the UK for more than 90 days in the 12 months immediately preceding the date of application; and
  • They must not have been subject to any immigration time restrictions in the 12 months immediately preceding the application; and
  • They must not have been in the UK in breach of immigration laws at any time during the five-year qualifying period.

Spouse Cases

For those applying on the basis of being "married to or in a civil partnership with a British citizen", the required residence period is three years, with the absence thresholds adjusted accordingly:

  • Applicants must not have been absent from the UK for more than 270 days during the three-year qualifying period; and
  • They must not have been absent for more than 90 days in the 12 months immediately preceding the application.

There is no requirement for spouses or civil partners to have been free from immigration control for 12 months prior to application, meaning they may apply immediately upon being granted indefinite leave to remain (ILR). There is also no requirement for spouses to intend to make the UK their permanent home, though they must meet the good character requirement and the English language requirement. Citizenship Ceremonies

Anyone over the age of 18 who wishes to acquire British Citizenship, whether by registration or naturalisation, must do so at a public citizenship ceremony. During the ceremony, they are required to take the Oath of Allegiance (or make an affirmation) and make a pledge of loyalty to the UK.

Naturalisation is at the discretion of the Home Office, meaning there is no right of appeal against a refusal of naturalisation.
